Actor Taye Diggs captures burglary suspect

LOS ANGELES (AP) ? Los Angeles police say actor Taye Diggs chased down and captured a burglary suspect he found rummaging through his garage.

It happened after the "Private Practice" star and his wife returned to their Studio City home from the Screen Actors Guild Awards, where Diggs was a presenter.

LAPD spokesman Richard French says shortly before 11:30 p.m. Sunday, Diggs saw a man in his garage, apparently looking for items to steal.

French says the man ran off, but Diggs followed him down the street and held him for police. Neither man was hurt.

Twenty-year-old Hassan Juma was arrested and remains jailed Monday on $50,000 bail.

One option that?s free even if you don?t have a cable subscription: the Home Shopping Network live streams its never-ending parade of product offers on its website and mobile apps.

Christian school sues ex-teachers in faith spat

A Christian school in Thousand Oaks, Calif., is suing two former teachers who threatened a lawsuit over the school's requirement to provide proof of faith.

When the Godspeak Church bought Little Oaks Elementary in 2009, it started requiring employees to fill out questionnaires that asked whether they attended church, which church they attended and what the pastor had to say about their beliefs.

"We do believe their personal rights were violated," said the teachers' attorney, Dawn Coulson.

Coulson said Lynda Serrano and Mary Ellen Guevara received their questionnaires last summer. After they refused to fill out the form, they were not rehired. The teachers then filed paperwork saying they intended to sue.

The school's attorney, Rick Kahdeman, said the church exercised its constitutional right to freedom of religion. He said that trumps any claim the teachers may have under state equal employment laws.

"The teachers chose not to [fill out the paperwork], and they knew it was a condition of employment," Kahdeman said.

Coulson contends that California's employment laws protect her clients, in part, because the school northwest of Los Angeles was purchased by a church as a for-profit entity, not a nonprofit. She said employers can't require such questionnaires as a basis for employment, even if they are churches.

"That would be like the church buying shares in IBM, and IBM saying, 'We can now discriminate, based on religion,'" Coulson said.

"That issue is totally irrelevant because the rights of the school come from the First Amendment to the Constitution," Kahdeman countered.

Kahdeman is suing the two teachers and their attorneys in federal court.

Bill Ackman On CNBC - Business Insider

Activist investor Bill Ackman, the founder of $12 billion Pershing Square Capital Management, and billionaire investor Carl Icahn brawled moments ago on CNBC's "Halftime Report" hosted by Scott Wapner.

It was one of the greatest moments in financial television with two hedge fund titans, who have been feuding for a decade, going head-to-head. Watch the full video here >

The segment was originally set up for Ackman respond after Icahn?blasted him?yesterday on Bloomberg TV.?

Yesterday, Icahn, who has publicly said before that he doesn't like Ackman and has "no respect" for him, ripped into his?"holier than thou" short on Herbalife in an interview with Trish Regan.?Icahn also called Ackman "disingenuous" and said he's not shorting Herbalife "for the good of humanity."?

Ackman then fired back yesterday evening in a?press release?saying Icahn is a good investor, but he doesn't keep his word. ?

He joined CNBC today to respond to his long time rival.

Earlier in the CNBC segment, Ackman told Wapner that he finds it interesting that Icahn thinks it's a bad thing that he gave a short at a Ira Sohn event when Icahn also gave a short thesis in 2002 and 2003 at a Sohn Conference.?

Ackman's Pershing Square is shorting more than 20 million shares of Herbalife ? a multi-level marketing firm that sells nutrition products. ?Ackman said at a Sohn Conference event last month that he thinks the company is a pyramid scheme and has a price target of zero.?

Minutes into the segment, Icahn called in after the first commercial break to respond to Ackman on live TV. ?It couldn't get any better!

He responded after Ackman basically called him a hypocrite.

"Listen. ?You know, I've really sort of had it with this guy Ackman, you know," Icahn told CNBC.

Icahn then started going over some history of a deal from back in 2003 over Hallwood Realty when Ackman ran Gotham Partners, which was being hit with redemptions and investigated by the SEC at the time over MBIA. (Ackman was never charged with any wrongdoing.)

If you're not familiar with the story, Ackman called Icahn and asked him to buy shares of Hallwood Realty, a real estate company trading for about $60, but Ackman said was worth $140. Hallwood merged with another company for $137 a share, Icahn wouldn't give Ackman a cut.

A lawsuit followed and?Ackman won and Icahn paid him $9 million Ackman's investors were owed.?

"I'm telling you he's like a crybaby in the schoolyard. ?I went to a tough school in Queens you know and they used to beat up the little Jewish boys. ?He was like one of the little Jewish boys crying that the world is taking advantage of him..." Icahn said when Ackman called him up in 2003, adding "You rue the day I ever met the guy."

He then started going over how Ackman's old firm Gotham Partners was being investigated by Eliot Spitzer and the SEC at the time and how he didn't realize that.

Icahn said this deal they did "cost him money." ?Ackman ultimately won in court. ?What's more is Ackman was never charged with any wrong doing on that SEC investigation over MBIA.

"He's the quintessential example of if you want a friend on Wall Street, get a dog," Icahn later said.

Wapner then let Ackman come into the conversation talking about his MBIA short. ?MBIA?alleged there was a "conspiracy to drive down its stock price." ?Ackman, who said MBIA didn't deserve a triple-A rating, ended up being right when the credit crisis hit.

There were a lot of insults flying during the segment. ?Ackman said that he wanted to defend his reputation. ?He also said it's not a "great use of CNBC air time."?

Then, it went back to Icahn and Wapner asked if he's long or not.

Icahn said he didn't come onto CNBC to be "bullied" after asked him that.

"No one's bullying you, Carl," Wapner responded.

"Listen to me... I want to say what I want to say and I'm not going to talk about my Herbalife position because you want to bully me...I don't give a damn about what you want to know.?I want to talk about what I want to talk about...You can say what the hell you want. ?I'm going to talk about what Ackman just said about me, not about Herbalife... I'll talk about Herbalife when I goddamn want to...I'm never going on a show with you again, that's for damn sure, OK."?Icahn shot back.

Throughout the segment, Icahn dropped some g-d bombs and "bullshit" and you could hear the floor traders at the NYSE reacting saying "Ooohhh!" ?

He then proceeded to slam Ackman. ?"As far as I'm concerned, he wanted to have dinner with me. ?I couldn't figure out if he was the most sanctimonious?guy I met in my life or just arrogant and that's Ackman," Icahn said. ?

Wapner, who was basically a referee, tried to ask Icahn if he was long Herbalife.

"Let me finish what the hell I want to say," Icahn snapped at Wapner. "You let Ackman talk."?

"I will tell you one day I think HLF will be the mother of all short squeezes," Icahn said claiming Ackman used the short to boost his return.?

"He talks about charity. ?That's complete bullshit!" Icahn said.?

Wapner gently reminded him that we're on live television. ?"That was an interesting choice of words," Wapner said.?Again, you could hear NYSE floor traders say "Ohhhh!."

Ackman then jumped in.

"The big issue about Carl Icahn, is he's not used to someone stepping up to him," Ackman said, "Especially like me in 2003."?

Wapner asked Icahn again if he's long Herbalife and what the motives are behind it.

Icahn said "bullshit" again and accused Wapner of "bullying" him. ?Again, the NYSE traders reacted screaming "Ohhh!" ?

The conversation turned back to the Herbalife short.

"If there's ever a short squeeze, what the hell does he do?" Icahn asks. ?"Ask him!"

Ackman said, "Carl is free to make a tender offer for the company."

"Hey, hey you don't have to tell me what I'm free today," Icahn shot back.

"What I thank Carl for is he helped highlight issues with Herbalife," Ackman said accusing him of buying the stock and selling it.

The attacks continued, though.

"I appreciate you calling me a great investor, but unfortunately I cannot say the same," Icahn said.?

"Bill, I appreciate you coming on. Carl, I hope you will come back," Wapner said.

Before Icahn called in...

Ackman says that Herbalife has done harm to millions of people and it deserves scrutiny. ?

He says the press wrote some "fun pieces" on Bill Ackman v. Dan Loeb or Bill Ackman v. Carl Icahn. ?He says the goal is to shed the truth about the company and get the press dig into it.?

He's talking about short selling in the market. ?He notes that it's unfortunate that they've lost some money so far.?

He says shorts play an important role in the market. ?

CNBC's Scott Wapner asked if Ackman is friends with Daniel Loeb of Third Point. ?

Loeb took an 8.24% stake (8.9 million shares) on the long side after Ackman's short calling Ackman's accusations "preposterous."?

Ackman said they've both been in the business a long time.?

"If he [Dan Loeb] stays long Herbalife, he will lose his entire investment," he said later in the interview.

Loeb is also reportedly short Nu Skin. ?Ackman says he doesn't understand why he would be short Nu Skin when he's long Herbalife. ??

Ackman says that he doesn't need to be "loved by everyone."?

He's also calling about Bob Chapman of Chapman Capital who he said came out and said he had a large position. ?Ackman says that Chapman Capital has less than a $100 million AUM.

On His JCPenney Stake...?

Ackman, who is the largest shareholder of JCPenney, is talking about that investment. ?He has taken a bath on the stock so far.

He's says CEO Ron Johnson has done some "incredible things," though.?

He said if Johnson can't turn it around in three years, then he's not the right guy.?

He does, however, expect the retailer to make progress.?

"Ron is going to work to solve the problems," he said. "I have enormous confidence in him...He's brilliant."?

Families and supporters of those accused of soccer violence from the Port Said soccer club react to the announcement of death sentences for 21 fans.

PORT SAID/CAIRO - At least 30 people were killed on Saturday when Egyptians rampaged in protest at the sentencing of 21 people to death over a soccer stadium disaster, violence that compounds a political crisis facing Islamist President Mohammed Morsi.

Armored vehicles and military police fanned through the streets of Port Said, where gunshots rang out and protesters burned tires in anger that people from their city had been blamed for stadium deaths last year.

The rioting in Port Said, one of the most deadly spasms of violence since Hosni Mubarak's ouster two years ago, followed a day of anti-Morsi demonstrations on Friday, when nine people were killed. The toll over the past two days stands at 39.

The flare-ups make it even tougher for Morsi, who drew fire last year for expanding his powers and pushing through an Islamist-tinged constitution, to fix the creaking economy and to cool tempers enough to ensure a smooth parliamentary election.

That vote is expected in the next few months and is meant to cement a democratic transition that has been blighted from the outset by political rows and street clashes.

The National Defense Council, led by Morsi and which includes the defense minister who commands the army, called for "a broad national dialogue that would be attended by independent national characters" to discuss political differences and ensure a "fair and transparent" parliamentary poll.

The statement was made on state television by Information Minister Salah Abdel Maqsoud, who is also on the council.

The National Salvation Front of liberal-minded groups and other opponents cautiously welcomed the call but demanded any such dialogue have a clear agenda and guarantees that any deal would be implemented, spokesman Khaled Dawoud told Reuters.

The Front spurned previous calls for dialogue, saying Morsi ignored voices beyond his Islamist allies. The Front earlier on Saturday threatened an election boycott and to call for more protests on Friday if demands were not met.

Its demands included picking a national unity government to restore order and holding an early presidential poll.

Threats of violence
The political statements followed clashes in Port Said that erupted after a judge issued a verdict sentencing 21 men to die for involvement in the deaths of 74 people after a local soccer match on February 1, 2012, many of them fans of the visiting team.

Visiting fans had threatened violence if the court had not meted out the death penalty. They cheered outside their Cairo club when the verdict was announced. But in Port Said, residents were furious that people from their city were held responsible.

Protesters ran wildly through the streets of Mediterranean port, lighting tires in the street and storming two police stations, witnesses said. Gunshots were reported near the prison where most of the defendants were being held.

A director for Port Said hospitals told state television that 30 people had been killed, many as a result of gunshot wounds. He also said the more than 300 had been wounded.

Inside the court, families of victims danced, applauded and some broke down in tears of joy when they heard Judge Sobhy Abdel Maguid declare that the 21 men would be "referred to the Mufti", a phrase used to denote execution, as all death sentences must be reviewed by Egypt's top religious authority.

There were 73 defendants on trial. Only a handful appeared in court in Cairo. Those not sentenced on Saturday would face a verdict on March 9, the judge said.

At the Port Said soccer stadium a year ago, many spectators were crushed and witnesses saw some thrown off balconies after the match between Cairo's Al Ahly and local team al-Masri. Al Ahly fans accused the police of being complicit in the deaths.

The fans, who call themselves "Ultras Ahlawy", said Saturday's ruling started the process of retribution, and hoped the rest would face the same fate when verdicts are issued on March 9.

Among those killed on Saturday was a former player for al-Masri and a soccer player in another Port Said team, the website of the state broadcaster reported.

Teargas rains down
On Friday, protesters angry at Morsi's rule had taken to the streets for the second anniversary of the uprising that erupted on January 25, 2011 and which brought Mubarak down 18 days later.

Police fired teargas and protesters hurled stones and petrol bombs. Nine people were killed, mainly in the port city of Suez, and hundreds more were injured across the nation.

On Saturday, some protesters again clashed with police. In the capital, youths pelted police lines with rocks near Tahrir Square. In Suez, police fired teargas where protesters angry at Friday's deaths hurled petrol bombs and stormed a police post.

"We want to change the president and the government. We are tired of this regime. Nothing has changed," said Mahmoud Suleiman, 22, in Cairo's Tahrir Square, the cauldron of the 2011 anti-Mubarak revolt and near where youths again stoned police.

Port Said, Ismailia and Suez, which have witnessed some of the worst violence in the past two days, lie on the Suez Canal but a canal official said there was no disruption to shipping through the waterway vital to international trade.

Morsi's opponents say he has failed to deliver on economic pledges or to be a president representing the full political and communal diversity of Egyptians, as he promised.

"Egypt will not regain its balance except by a political solution that is transparent and credible, by a government of national salvation to restore order and heal the economy and with a constitution for all Egyptians," prominent opposition politician Mohamed ElBaradei wrote on his Twitter account.

Morsi's supporters say the opposition does not respect the democracy that has given Egypt its first freely elected leader.

The Muslim Brotherhood, which propelled Morsi to office, said in a statement that "corrupt people" and media who were biased against the president had stirred up fury on the streets.

The political schism between Islamists and secular Egyptians and frequent bouts of violence have hurt Morsi's efforts to revive an economy in crisis as investors and tourists have stayed away, taking a heavy toll on Egypt's currency.

Mustapha Kamal Al-Sayyid, a professor of political science at Cairo University, said the latest violence reflected the frustration of many liberal-minded Egyptians and others.

"The state of polarization between Islamists and others is most likely to continue and will have a very negative impact on the state's politics, security and economy," he said.

The aftermath of the Great Recession may very well be read in an increase in the number of tax levies on wages, as employees scrimped on their taxes to pay for other things. The IRS isn?t sympathetic, and that?s bad news for you. Tax levies, with their different withholding and remittance rules and paperwork requirements are an inconvenience for already overworked Payroll departments.

Liability lessons

Employees who have shorted the IRS may not be too happy about having to pony up on the back end through tax levies. A couple of recent cases reaffirm that you aren?t liable for withholding under a tax levy.

  • A federal appellate court ruled that an employer wasn?t liable to an employee for honoring a tax levy. Among the employee?s more colorful allegations against his employer were that it breached its fiduciary duty, committed fraud and negligence, intentionally inflicted emotional distress and tortuously interfered with contract and business relationships. (Hughes v. Chevron Phillips Chemical Company LP, No. 11-10698, 5th Cir., 2012)

  • A federal trial court dismissed an employee?s lawsuit seeking $445,000 in damages from his employer for honoring a tax levy. Employee?s allegations: He never agreed to withholding under the levy, and, by withholding, the employer breached its at-will contract with him; the cash damages were to compensate him for lost wages, lost investments, loss of the ability to pay normal bills and mental anguish associated with those losses. (Al-Sharif v. Epes Transport System, Inc., No. 1:11-cv-00037, D.C. S. Ga., 2012)

PAYROLL PRACTICE TIP: As these cases show, employees (and their lawyers) can be pretty creative. Regardless of the frivolous nature of these lawsuits, the company and individual employees will still be forced to hire attorneys and go to court to have such cases dismissed. Advice: Consider ?adopting a policy under which employees will be terminated for bringing frivolous lawsuits.

How tax levies work

The IRS will send you Form 668-W, which contains instructions for you and the employee. It also provides levy tables, which are inflation-adjusted every year, from which you figure the employee?s take-home pay.

Tax levies take priority over all other garnishments. Exceptions: If the employee?s wages are also subject to a state tax levy or an order for child support withholding, and those levies were served first, they are honored first. If all levies are served simultaneously, the federal levy is honored first.

To implement a levy, take these steps.

  1. Figure the employee?s regular income tax withholding, plus pre-levy voluntary deductions. Watch it: New deductions, or an increase in existing deductions, usually aren?t allowed. What?s OK: increases in 401(k) deductions that are based on salary increases. What?s not OK: increases to repay a company loan (the original deduction to repay the loan is OK).

  2. To arrive at the employee?s take-home pay, use the 2013 tables for levies beginning this year. The difference between the amount left after regular withholding and the exempt amount, as shown in the levy tables, is the amount you send to the IRS to satisfy the levy. If you?re honoring a levy from a prior year, continue using the tables that were in effect for that year, unless the employee changes the number of exemptions or updates his/her parts of Form 668-W for 2013. In that case, use the 2013 tables to recalculate the exempt amount. The IRS publishes these tables in Pub. 1494, which is available on the IRS? website.

  3. You can send one check to the IRS for multiple tax levies, but you must separately list the details of each employee?s levy. Include a phone number that the IRS can use if it has questions.

Take it. It?s yours

An employee who chooses not to incur the wrath of the IRS and the Payroll department can stave off a levy by entering into a voluntary withholding agreement with the IRS. Of course, any voluntary agreement to withhold back taxes requires the employer?s consent. If you agree, you and the employee complete and file Form 2159 with the IRS.

FYI: As with levies, withholding is separate from regular income tax withholding. Once withholding begins, it continues until the IRS provides a release.

Feds: 3 nabbed for widespread Gozi computer virus - Idaho Statesman

? Authorities say the inventor of a computer virus that infiltrated a million computers worldwide and opened the door for the theft of at least $50 million has pleaded guilty to federal charges in New York.

A federal prosecutor told a news conference Wednesday that Nikita Kuzmin (KOOZ'-mihn) entered the plea to computer intrusion and fraud charges in May 2011.

The prosecutor, Preet Bharara (bah-RAHR'-ah), says the Russian man created the Gozi (GOH'-zee) virus in 2005 that was used to gain access to NASA computers last summer.

He says Kuzman's plea was followed by the arrest in November of a co-conspirator in Latvia and another in Romania last month. Extradition proceedings are underway against both.

Authorities say the virus was used to infect at least 40,000 computers in the United States.

Three men were in custody Wednesday on charges that they spread a computer virus to more than a million computers worldwide, including at least 40,000 in the United States, siphoning out passwords and online banking information that allowed hackers to steal tens of millions of dollars.

Their arrests were announced as federal authorities unsealed documents in Manhattan federal court accusing the men of participating in a conspiracy that began in 2005 and continued through much of last year. NASA computers were among those infected by what was labeled the Gozi virus.

The NASA breach occurred from Dec. 14, 2007, to Aug. 9, 2012, when about 190 agency computers were infected with the virus, according to court documents. Between May and August last year, they said, the infected computers sent data without the user's authorization, including login credentials for an eBay account and a NASA email account, details of visited websites and the contents of Google chat messages.

Other destructive viruses and malicious software, including Zeus Trojan, SpyEye and BlackEnergy, were distributed through the network, according to a criminal complaint filed against Mihai Ionut Paunescu, also known as "Virus."

Paunescu is a Romanian national residing in Bucharest. According to court papers, Romanian organized crime investigators have been conducting their own probe of him that included court-authorized surveillance of his cellphone communications over the last year.

The document said Paunescu set up online infrastructure that allowed others to distribute the damaging programs, causing tens of millions of dollars in losses and affecting well over a million computers worldwide.

The Gozi virus was designed in 2005 and distributed beginning in 2007, when it was secretly installed onto each victim's computer in a manner that left it virtually undetectable by antivirus software, the complaint said.

FBI agent M. Kathryn Scott wrote in the complaint charging Paunescu with conspiracy to commit computer intrusion that some information about the virus came through the cooperation of a Gozi virus distributor who pleaded guilty to various fraud and computer intrusion charges and was cooperating with U.S. law enforcement officials in the hopes of receiving leniency at sentencing.

Paunescu was arrested in Romania. Deniss Calovskis was arrested in Latvia, where he is a citizen and resident, on charges including bank fraud conspiracy. Nikita Kuzmin, a Russian national, was arrested in New York on various charges, including bank fraud and bank fraud conspiracy.

It was not immediately clear who would represent the defendants in court.

A charging document against Kuzmin accused him of designing the Gozi virus beginning in 2005 as a way to steal the personal bank account information of individuals and businesses in a widespread way.

It said he hired a programmer to write it and began in 2006 to rent the virus to others for a weekly fee, advertising it on Internet forums devoted to cybercrime and other criminal activities. In 2009, according to the document, Kuzmin was approached by others who wanted to acquire the source code so they could attack computers and steal money from bank accounts in the United States and in particular European countries. The document said Kuzmin offered the code to other groups of people for $50,000 plus a guaranteed share of future profits.

According to court documents, Calovskis had training and expertise in computer programming when he was hired by a co-conspirator to upgrade the virus with new code that would deceive victims into divulging additional personal information, such as mother's maiden names. Federal authorities sought at least $50 million from Calovskis, an amount of money they said was obtained through the conspiracy.

Insurgents hit police facility in Afghan capital

(AP) ? Taliban insurgents wearing suicide vests attacked the Kabul traffic police headquarters before dawn Monday, police said, and eyewitnesses heard numerous explosions and a still-raging gun battle two hours later.

Police officer Mirza Mohammad said at least one insurgent blew himself up at the entrance to the compound and a number of others wearing suicide vests entered the building. Another police officer said at least three attackers entered the building and two were killed, possibly by detonating their vests. The officer, who could not be named because he was not authorized to speak to the media, said a gun battle was taking place inside the three-story building.

"There are still there are two or three suicide bombers inside the traffic department compound. They are still fighting," said Mohammad Zahir, the chief of the Kabul police investigation unit. He did not provide any information on casualties. Explosions could be heard inside the building.

Taliban spokesman Zabiullah Mujahid claimed responsibility for the attack in a text message to The Associated Press.

Gul Rahman, who owns a nearby shop, said he heard at least two explosions when the attack started just before dawn. An Associated Press reporter at the scene said a number of big explosions were heard in and around the building along with heavy gunfire.

Traffic police headquarters is located on square leading to the Afghan parliament and is next to the Kabul zoo. It is also next to the Afghan border police headquarters. The facility, usually teeming with civilians seeking to get drivers licenses and registrations for vehicles, was nearly empty at the time of the attack.

It was the second insurgent attack inside Kabul in less than a week.

Last Wednesday, six Taliban suicide bombers attacked the gates of the Afghan intelligence agency in downtown Kabul, killing one guard and wounding dozens. Security forces killed all the attackers. The insurgents carried out the attack by driving a minivan loaded with explosives into a gate of the intelligence agency compound in the capital at noon. The other five attackers wearing suicide vests were in a second minivan that was also loaded with explosives. They were shot and killed and security forces later defused the bomb in their minivan.

The attacks highlighted ongoing violence in Afghanistan and the determination of the insurgency to continue fighting even as President Hamid Karzai and the U.S. negotiate for a quicker pullout of American forces.

But Kibera, one of Nairobi?s slums and arguably Africa?s largest slum, is exactly that for the Kenyans who call it home. In The Economist, a writer chronicled a day in Kibera, describing the slum?s ebbs and flows, capturing its entrepreneurial spirit. People from all over Kenya leave their towns and villages for a chance to find work in Kibera?s ?thriving economic machine.?

The half-mile-by-two-mile area accommodates roughly 1 million people, wedged together in repurposed wood-and-corrugated-tin-roof structures. The alleys that wind through the slum vary in size, but there is no room for cars. Many of the residents work in nearby factories or offices. Others find economic opportunity in providing goods and services for Kibera?s residents.

When Cecilia Achieng moved to the slum, she started a school, at first renting space from an empty church. She eventually saved enough money to build six makeshift classrooms. After school, Ms. Achieng starts her second job: catering. She caters church events, funerals, and is even trying to get into weddings. In the evening, Achieng goes door to door offering her services as a hairdresser.

?To equate slums with idleness and misery is to misunderstand them,? the correspondent writes. ?Slums are far from hopeless places; many are not where economic losers end up, but rather reservoirs of tomorrow?s winners.?

The promise of the Arab Spring

As post-Arab Spring countries struggle to establish democratic institutions, pessimism about their ultimate success misses a broader lesson: Stable democracies have historically evolved from violent uprisings, initial failures, and stumbling blocks.

?These troubles ... are not a bug but a feature ? not signs of problems with democracy but evidence of the difficult, messy process of political development through which societies purge themselves of the vestiges of dictatorship and construct new and better democratic orders,? writes Sheri Berman in Foreign Affairs.

Critics who see Egypt, Libya, and other transitioning countries as democratic failures ignore the inherited social, cultural, and political dynamics in these countries, and a broader historical perspective. New democracies are not blank slates, writes Ms. Berman. In the aftermath of overthrowing dictators, countries must overcome the baggage that comes with authoritarian regimes ? distrust, animosity, and lack of civil organizations to deal with people?s demands. Islamism is filling that void in Egypt after Hosni Mubarak?s fall as religious organizations were the only places where people could participate and express themselves.

Hall Findlay blasts Harper?s ?absolute, blind, unilateral support of Israel, at all costs?

Federal Liberal leadership hopeful Martha Hall Findlay?has hit out at Stephen Harper for what she has called his ?absolute, blind, unilateral support of Israel, at all costs.?

The former Toronto MP claims such a one-sided approach is ?not conducive to a solution? to the conflict between Israel and the Palestinians. Canada should be able to strongly support Israel but still have the courage to criticize where criticism is warranted, she said, citing Israel?s intention of allowing more settlements in strategic areas of the West Bank.

In a wide-ranging interview, Hall Findlay said she?d be willing to entertain a wealth tax on the richest Canadians, although she wouldn?t countenance any tax increase while the economy remains sluggish.

She also said she?d claw back more old age security benefits from relatively well-off seniors, but?wouldn?t?promise to run for the Liberals in the next federal election if she loses her bid to become party leader.

Hall Findlay is one of six leadership contenders who currently have no seat in the House of Commons. Only three ? Justin Trudeau, Marc Garneau and Joyce Murray ? are sitting MPs.

She also weighed in on the aboriginal protests that have rocked the country, urging police to do their jobs to break up illegal demonstrations and calling on Attawapiskat Chief Theresa Spence to end her month-long hunger protest.

Hall Findlay?won the Toronto riding of Willowdale in a 2008 byelection and was re-elected in a general election later that year. But she lost to Conservative Chungson Leung in the 2011 election, when the Liberals were reduced to a third-party rump with only 34 seats.

Should she win the leadership, Hall Findlay said it ?would not be the preference? to remain out of the Commons for an extended period. But precisely how and when she?d find a seat would ?have to be determined at the time.?

Ideally, she?d ?love to run again in Willowdale? but she acknowledged Leung is unlikely to step aside to accommodate her.

Former prime ministers Brian Mulroney and Jean Chretien were elected leader of the Conservatives and Liberals respectively, without having a seat. In each case, they persuaded one of their sitting MPs to step aside temporarily, allowing the leader to run in a byelection in a safe riding.

That could prove more difficult for the next Liberal leader since there are so few sitting Liberal MPs and even fewer ridings that could be deemed safe for the party.

Still, Liberals may feel it?s less urgent for the new leader to be in the Commons, since there is so much work to be done rebuilding the party across the country.

Trudeau, eldest son of late Liberal icon Pierre Trudeau, is widely perceived to have a huge lead over his eight rival contenders, including Hall Findlay, who was first off the ballot in the party?s 2006 leadership contest.

Hall Findlay did not dispute the perception that Justin Trudeau is the prohibitive favourite but she maintained the reality on the ground is somewhat different. In her opinion, former cabinet minister Martin Cauchon, who joined the contest just before the deadline Sunday, would not have taken the plunge had he thought Trudeau had it wrapped up.

?We?re not naive. We know that (Trudeau) came out of the gate absolutely the front-runner with a huge amount of ? media attention. That, in and of itself, creates a significant advantage, for sure.

?But I?m really interested in how, in a very short time, the discourse has changed from coronation and juggernaut to a Liberal leadership race,? she said, adding that there are plenty of examples of leadership races in which the front-runner ultimately lost.

On the upheaval over the federal government?s relationship with First Nations, Hall Findlay blasted Prime Minister Stephen Harper ? and the NDP, which helped defeat the Liberal government in 2005 ? for scrapping the Kelowna accord, which would have pumped $5 billion over five years into improving the quality of life for aboriginal peoples.

That has led to the frustration that?s boiled over in illegal road and bridge blockades, Spence?s month-long hunger protest and the Idle No More movement, she said.

That said, Hall Findlay also said the illegal protests, as well as Spence?s refusal to give up her liquid-only diet, even after last Friday?s meeting between some chiefs and Harper, have made it more difficult to achieve solutions.

?It has certainly brought emotions to a level and some of the discourse to a level that has not been ultimately very productive, which I feel very badly about,? she said, calling on Spence to end her hunger strike.

Hall Findlay also sided with judges, who have admonished the police for their reluctance to break up illegal protests, apparently afraid of provoking a violent confrontation.

?My view is, the police should do their job.?

On other issues, Hall Findlay:

? Stressed she?s not advocating any tax increases while the country is still struggling to emerge from a crippling recession. Once the economy rebounds, however, she reiterated her willingness to at least consider reversing the Harper government?s two-percentage-point reduction in the GST and put a price on pollution. She also said she?d be ?willing to entertain? a surtax on the wealthiest Canadians.

? Said it makes no sense that the government only begins to claw back old age security benefits from seniors with net incomes of $70,000 or more and only claws them back totally for those with incomes of more than about $110,000.

?I am of the belief that those who can, should be responsible for their own retirement ? Why on earth are Canadian taxpayers giving money to people who are making $110,000 net income at the age of 65??

Creativium - Paper Theater for iPad review

Building construction paper landscapes is a fiddly affair. No matter how many times you map out the positions of your cutouts, some errant breeze always pops up at the last minute to slide them out of place. Creativium - Paper Theater looks to eliminate this problem by setting up the paper dioramas inside of your iPad.

In the app, you're greeted with an undeniably child-friendly woodland scene with cute animals blinking up at you. Tapping around on the environment can cause certain animals to wake up or wander about, but most stay where they are.

When you find a particularly choice view in the paper wonderland, you can conjure up a virtual camera in-app to take a picture of what you see. It's all pretty and good fun, but it gets old rather quickly.

Toddlers will eat this up, apparently

The problem with the app as it stands, however, is that it only presents one diorama for you to play with and your options for playing are rather limited. Tapping on critters doesn't elicit much - if any - of a reaction, and there?s only one area that you can really customize.

This area - a castle - is cute enough, and the ability to festoon it with streamers, balloons, clowns, and wizards is nice but after you take a picture there's really nothing to do with it.

No doubt children, with attention spans shorter than your average app reviewer, will see the novelty of Creativium wear off quickly. Compounding this issue is that there's only one diorama available for them to play with, so there aren?t many options for those looking to fiddle and wander.

Creativium doesn't need to add more for children to do to redeem it as an app, it just needs to add more areas for them to play in. Having virtual paper playworlds at your fingertips is something any kid could sink their baby teeth into, but the key to keeping them interested is variety.

At current, Creativium doesn't really provide much of that.

US businesses increased stockpiles 0.3 percent

(AP) ? U.S. companies increased their stockpiles a steady pace in November from October, responding to a solid increase in sales.

The Commerce Department said Tuesday that business inventories grew 0.3 percent in November, matching the October gain.

Sales rose 1 percent in November, the best showing since a 1.2 percent rise in September. In October, sales had fallen 0.3 percent, reflecting in part disruptions caused by Superstorm Sandy.

More restocking leads to more factory production, which boosts economic growth. Faster restocking helped the economy grow at a 3.1 percent annual rate from July through September.

Most economists say inventory growth has slowed from this summer, a key reason many are predicting economic growth weakened to a rate below 2 percent in the October-December quarter.

The inventory to sales ratio has held steady since August, a sign that businesses were not expecting much growth in sales. In November, the ratio was 1.28 months. That means it would take about five weeks to exhaust stockpiles at the November sales pace.

The sales gain in November was led by a 2.3 percent surge in demand at the wholesale level. A separate report Tuesday showed that retail sales increased again in December, rising 0.5 percent, the best showing since September.

Total inventories rose to a seasonally adjusted $1.62 trillion in November, up 23.9 percent from the recession low hit in September 2009.

Retail inventories rose 0.6 percent in November, leading all categories. Wholesale stockpiles grew 0.3 percent, while manufacturing inventories were flat.

Income growth remains weak, constraining the amount that consumers can devote to increased spending. Consumer spending drives roughly 70 percent of economic activity.

Job growth has been steady, although unemployment is still high at 7.8 percent. In December, employers added 155,000 jobs, roughly matching the monthly average in 2011 and 2012.

The economy has shown some signs of improvement. The once-battered housing market is recovering, which should lead to more construction jobs in the coming months. Autos sales in 2012 were the best in five years. And a gauge of U.S. service firms' business activity expanded in December by the most in nearly a year.

Burr blasts president's gun control plan

WASHINGTON, DC (WWAY) -- President Obama's plan to increase gun control in the United States is meeting opposition from North Carolina's Republican senator.

In a statement released today, Sen. Richard Burr said he does not support the president's $500 million package of executive actions and legislative proposals aimed at reducing gun violence.

"I will fight any effort to further infringe on the Second Amendment rights of American citizens, whether it is legislation or executive action by the president," Burr said. "I am open to having a conversation about ways in which our nation can address mental health issues and reduce violence, but I will not stand by while the president and others try to restrict the rights of law-abiding American citizens."

Nev. manager wants to change city 'hamburger' logo

HENDERSON, Nev. (AP) ? The city manager in Henderson, Nev., says he wants to update the city's logo after it was mistaken for a hamburger.

Jacob Snow tells the Las Vegas Review-Journal (http://bit.ly/UYTLJD ) the logo is too detailed to reprint clearly on small items such as business cards. He also says he doesn't like the image's saguaro cactus, which is not native to the Mojave desert.

The circular logo was adopted in 1993 and features a mountain range, a lake, buildings and a golf course through the middle. City spokesman Bud Cranor says the more than 14 different colors on the image make it difficult to replicate.

Insurers look to build on mandate - GOP looks to stop rape comments - Just how bad is this flu season? - GOP considers default, shutdown in spending fight

GET READY TO HEAR ABOUT THE MANDATE AGAIN ? The fight to strike out the individual mandate is over ? now get ready for the fight over making the mandate stronger. The Obama administration backed the mandate when it determined that was the best way to enroll enough healthy people to pay for the sick ones who?ll be covered starting 2014. But there are real concerns that the mandate penalties aren?t strong enough, especially in the early years when the sickest patients can enroll right away. Insurers are telling the administration more incentives ? like a late enrollment fee ? are necessary to get healthy people to sign up sooner, and language in a recent HHS rule suggests the administration is willing to listen to some ideas. Phil Gingrey?s recent attempts to explain Todd Akin?s rape remarks felt like a throwback to the 2012 campaign: Republican says something dumb about rape, then Democrats and their allies jump all over the remarks to paint the party as radical. Those kinds of comments may have hurt Republicans? chances of taking back the Senate, and party members are wondering how to make it all stop. For some, the answer is easy: Just shut up. ?This is actually pretty simple. If you?re about to talk about rape as anything other than a brutal and horrible crime, stop,? said Republican strategist Kevin Madden, who was a senior adviser in Mitt Romney?s campaign. The Susan B. PRELIMINARY INJUNCTION DENIED IN CONTRACEPTION LAWSUIT ? The conflicting rulings continue to pile up in cases against the administration?s contraception coverage rule. Conestoga Wood Specialties Corp., a Mennonite-owned wood cabinet company, was denied a preliminary injunction Friday against the rule. A judge from the District Court of Eastern Pennsylvania said the plaintiffs didn't prove that providing contraception coverage provided a substantial burden on the owners' religious exercise. KAISER FOUNDATION SCALING BACK STAFF ? Layoffs came to the Kaiser Family Foundation last week, but the health policy and communication organization isn?t saying how much it?s scaling back. DEMS TO GUN PANEL: DON?T FORGET ABOUT THAT 2008 MENTAL HEALTH LAW ? With Vice President Joe Biden?s gun task force supposed to issue recommendations by Tuesday, Democratic lawmakers are highlighting a focus on mental health ? particularly enforcement of a law already on the books. Sen. Al Franken and HELP Committee Chairman Tom Harkin called on the administration to fully implement the 2008 Mental Health Parity and Addiction Equity Act. Under the law, ?millions of Americans with health insurance are entitled to access to a full range of mental health and substance use disorder services,? they wrote in a Friday letter to Biden. ?However, while this historic law was passed four years ago, the administration has yet to issue a final rule, potentially leaving many Americans who need and have a right to these services without access to them.? 300 jobs will come to Olive Branch

OLIVE BRANCH, MS- (WMC-TV) ? A new company is bringing hundreds of jobs to Olive Branch.

An undeveloped lot will eventually become home to the new Helen of Troy warehouse. It is expected to bring about 300 jobs to the city.

Olive Branch Mayor Sam Rikard says it is something that has been in the works for at least six months.

The New Helen of Troy warehouse will be one of the first things people see coming to Olive Branch from the east.

DeSoto County is looking to finalize incentives to bring the company's second warehouse to the county.

Mayor Rikard says the undeveloped land currently brings in about 14,000 to the city, but the warehouse will bring in much more.

"Even with the tax incentives that we're offering, they're going to be paying the city of Olive Branch about a $120,000 a year," said Mayor Rikard.

On top of the additional revenue for the city and county, even more tax money will flow into the school systems in DeSoto County.

The consumer product manufacturer is expected to close one of its current facilities in Memphis in wake of the move to DeSoto County.

"I understand that ultimately the Memphis location will close and you would expect those employees to transfer, I'm told we'll have up to 400 employees," explained Rikard.

The warehouse is expected to open at some point in 2014.
